Deed Services

We offer a complete range of services from the establishment of a self managed superannuation fund through to the amendment of existing trust deeds. Our deed document has been prepared for us by Cooper Grace Ward Solicitors. We consider it to be one of the most comprehensive deeds currently available.

Services available include:

 

Establishment of a SMSF

We attend to the establishment of self managed superannuation funds (SMSF), providing Trust Deeds, Minutes, Consents to Act as a Trustee, Trustee Declarations, Membership Applications Forms, Product Disclosure Statements etc.

Our trust deed is comprehensive and provides trustee with options such as:

  • Acceptance of spouse contributions
  • Acceptance of contributions for members age 65 and over
  • Splitting contributions with spouses
  • Ability to retain benefits in the fund regardless of age or work status
  • Payment of account based pensions and market linked pensions
  • Payment of transition to retirement income streams
  • Acceptance of binding death benefit nominations
  • Recoupment of tax via an anti-detriment benefit payment
  • Flexibility in the payment of death benefits, including payments to persons in interdependency relationships

Costs
Our fee for attending to the establishment of a SMSF is $595 including GST.

Amendment to Existing Trust Deeds

We attend to the amendment of existing self managed superannuation fund trust deeds.

This may be appropriate if the fund’s existing deed becomes out-dated and restricts the trustee, for example, in the type of benefits which may be paid or the acceptance of contributions.

We are also able to review an existing trust deed and advise whether there are any inadequacies.

Costs
Our fee for attending to the amendment of a trust deed is $650 including GST. Amendments are made by completely replacing the existing deed. Please note, this fee may vary if the fund is a defined benefit fund.

Change of Trustees

We attend to changes in the trustee of an existing superannuation fund.

This may be appropriate if, for example, there is a change in the membership of the fund. If the trustee is to change from a corporate to an individual trustee, it may also be appropriate to amend the trust deed.

Costs
Our fee for attending to the retirement and/or appointment of trustees is $650 including GST.

Should the deed also require amending, our total fee would be $865 including GST.

Appointment of an Enduring Power of Attorney

We attend to the preparation of Enduring Powers of Attorney.

An Enduring Power of Attorney may be required to ensure a fund meets the definition of a self managed superannuation fund (eg where all members are not trustees).

Costs
Our fee for attending to the preparation of an Enduring Power of Attorney is $440 including GST.

Binding Death Benefit Nomination

We attend to the preparation of Binding Death Benefit Nominations.

A member of a fund may be permitted to nominate a particular person or persons to whom they would like their benefits to be paid on their death. Such a nomination will be binding upon the trustees (ie they must pay the benefits to the person(s) nominated).

Our nominations may be either lapsing or non-lapsing depending on the wording of the fund's trust deed.

Please contact us if you require advice concerning whether a Binding Death Benefit Nomination is appropriate for your circumstances.

Costs
Our fee for attending to the preparation of a Binding Death Benefit Nomination is $330 including GST.

If the deed does not currently allow for the acceptance of a binding nomination, our fee to amend the deed and prepare the binding nomination would be $980 including GST.

Review Existing Trust Deed

We attend to the review of existing trust deeds.

This may be appropriate if the trustee wishes to adopt a particular course of action and needs to check whether this may be in conflict with the fund’s current trust deed. For example, a trustee may wish to pay member benefits in the form of a pension or accept a binding death benefit nomination from a member.

We will advise whether there are any inadequacies and recommend whether an amendment to the existing trust deed is appropriate.

Costs
Our fee for attending to the review of a trust deed is a minimum of $330 including GST.

New Member Documentation

We attend to the preparation of documentation to admit new members to self managed superannuation funds, including Trustee Minutes, Membership Application Forms, Product Disclosure Statements and ATO notification of change of details.

Costs
Our fee for preparing the new member documentation is a minimum of $330 for the first new member including GST. (plus $165 for each additional member)  Please note this fee may vary if the fund's trust deed was not originally prepared by us or Cooper Grace Ward.

Should the new members also be required to be admitted as trustees, a further $540 including GST would be charged.
